The Employment and Labour Relations Court has rejected a petition by former Kenyan Senior Intelligence Officer Samson Gekura Tuguro, who challenged his dismissal from the National Intelligence Service (NIS) over bribery allegations.
In its ruling on September 6, 2024, the court ruled that his dismissal was fair and lawful, citing serious misconduct related to soliciting and accepting bribes while working as a passport vetting officer.
Bribery Allegations Supported by Evidence
Tuguro was accused of corrupt activities between November 2021 and March 2022, leading to unexplained deposits of Sh3.14 million in his bank account.
An investigation by the NIS Disciplinary Board presented evidence linking him to a scheme that expedited passport processing for money. Testimonies from his supervisors and colleagues revealed that Tuguro had taken bribes from the public and fellow officers to speed up the passport vetting process.
When questioned about the sudden increase in his bank deposits, Tuguro failed to provide a clear explanation.
Although he claimed innocence, the disciplinary board concluded that he violated the NIS Disciplinary Rules and Regulations (DRR), justifying his immediate dismissal.
